Bottom Line: According to our interpretation of the law in England (not Wales as Wales recently banned the consumption of electronic cigarettes in public places for the most ludicrous and weightless reason- read our blog to find out why!), e-shisha can be legally consumed in public venues that are otherwise subject to smoking restrictions. Please see below our interpretation of the relevant authorities.

Tobacco Advertising and Promotion Act 2002, the tobacco product is given the following statutory definition:
“ “tobacco product” means a product consisting wholly or partly of tobacco and intended to be smoked, sniffed, sucked or chewed.”
The Health Act 2006 provides the following definition for smoking:
“lit tobacco or anything lit that contains tobacco, or of any other lit substance in a form in which it could be smoked”.
E-Shisha and steam stones are not “lit substances” and therefore do not qualify as smoking for the purposes of the aforesaid act.
Furthermore, the Niche Tobacco Products Directory (thereafter NTPD) operated by Trading Standards Institute, Department of Health and HM Revenue and Customs provides the following guidance on Shisha tobacco products:
“At the commencement of any investigation or the offer of advice involving a shisha tobacco product, it is vital that the product is correctly identified as this will determine which regulations apply. This directory will assist in identifying the more common brands of shisha tobacco. It is important to recognise that shisha is a smoked product. In the majority of cases, the product as supplied will contain (among other things) tobacco. However, there are also varieties of herbal shisha that do not contain tobacco. It may therefore be necessary for the product to be tested by an accredited test facility to confirm that the product contains tobacco and thus falls within the definition of a ‘tobacco product’.
Once established as a tobacco-containing product, the relevant aspects of existing tobacco control legislation will apply in broadly similar way to familiar tobacco products such as cigarettes.”
Firstly, the guidance on the tobacco laws correctly refers to “shisha tobacco” instead of just “shisha” thus drawing a distinction between “shisha” and “shisha tobacco”. Secondly, the guidance provides that it must first be satisfied that the product is indeed a “tobacco-containing product” before “the relevant aspects of existing tobacco control legislation will apply”.
According to a publication by Southwark City Council titled ‘Trading Standards Information, e-cigarettes and e-shisha product safety’, the electronic cigarettes and electronic shisha containing nicotine are not regulated and do not constitute a tobacco product. The publication even states that “These devices are not currently subject to any age restrictions. However best practice would be not to supply them to persons under 18 in line with traditional tobacco products.” This in turn supports the premise that electronic shisha is not a tobacco product
The Urban Dictionary provides the following definition of vaping: “To inhale vapor from E-cigarettes. Used because “smoking” an E-cig doesn’t apply as there is no smoke only vapor.”
